MJM Ultimate Services provides personal protective equipment ("PPE"), safety equipment, tools, consumable materials, and related products primarily for utility contractors, construction contractors, industrial customers, and other commercial users.

Product descriptions, specifications, images, availability, and pricing are provided for informational purposes and may be updated or corrected without prior notice.

Customers are responsible for selecting products appropriate for their intended application and ensuring that products are used, inspected, maintained, stored, and replaced in accordance with applicable laws, regulations, industry standards, employer requirements, and manufacturer instructions.

MJM Ultimate Services does not assume responsibility for a customer's selection, misuse, modification, improper storage, failure to inspect, or improper application of any product.

​

Where PPE or safety equipment requires specific sizing, ratings, certifications, training, inspection, or compatibility with other equipment, the customer is responsible for verifying those requirements before use.

MJM Ultimate Services makes reasonable efforts to provide accurate product descriptions and specifications. However, manufacturers may modify products, packaging, specifications, certifications, colors, or designs without notice.

Manufacturer documentation and instructions supplied with a product should be followed at all times.

​

In the event of a conflict between general information provided by MJM and the manufacturer's current safety instructions, warnings, or specifications, the manufacturer's information shall control.

All prices are subject to change without notice unless otherwise stated in a written quotation or agreement.

Product availability is not guaranteed until an order has been accepted and processed by MJM Ultimate Services.

MJM reserves the right to correct pricing, description, inventory, or typographical errors and may cancel or modify an affected order when reasonably necessary. If payment has already been collected for a canceled item, the applicable amount will be refunded.

Submission of an order does not necessarily constitute acceptance by MJM Ultimate Services.

MJM reserves the right to accept, reject, limit, or cancel an order for legitimate business reasons, including product availability, pricing errors, suspected fraud, credit concerns, manufacturer restrictions, or shipping limitations.

​

Large-volume, special-order, custom, embroidered, printed, or customer-specific orders may be subject to additional terms communicated at the time of purchase.

Customers purchasing through a company, contractor, utility, municipality, or other organization represent that they have authority to make purchases on behalf of that organization.

​

Customers are responsible for maintaining the confidentiality of account credentials and for purchases made through authorized users associated with their account.

​

Account-specific pricing, credit terms, purchase-order requirements, or other negotiated terms may be governed by a separate written agreement. Where a separate written agreement conflicts with these Terms, the written agreement will control with respect to that transaction.

Payment is due according to the terms stated during checkout, on the applicable invoice, quotation, credit agreement, or other written agreement with MJM Ultimate Services.

Customers with approved credit accounts are responsible for paying invoices according to their established payment terms.

​

MJM reserves the right to suspend credit privileges, delay additional shipments, or require payment before shipment for accounts that are past due, subject to applicable law and any separate written agreement.

Shipping and delivery dates are estimates unless MJM expressly agrees otherwise in writing.

MJM Ultimate Services is not responsible for delays outside its reasonable control, including carrier delays, manufacturer shortages, supply-chain disruptions, severe weather, labor interruptions, natural disasters, government actions, or other events beyond MJM's reasonable control.

​

Customers should inspect shipments promptly upon receipt and report shortages, incorrect products, or visible shipping damage in accordance with MJM's Return and Refund Policy.

Certain products sold by MJM Ultimate Services are intended to reduce exposure to workplace hazards but do not eliminate those hazards.

​

Purchasing PPE or safety equipment from MJM does not replace an employer's obligation to conduct hazard assessments, provide required training, establish safe work procedures, inspect equipment, or comply with applicable OSHA requirements, ANSI standards, manufacturer requirements, contractual requirements, or other applicable safety regulations.

​

Customers and employers remain responsible for determining whether a particular product is appropriate for a specific hazard or work activity.

Products may be covered by warranties provided by their respective manufacturers. Except as expressly provided by MJM in writing and to the fullest extent permitted by applicable law, MJM makes no additional warranties beyond applicable manufacturer warranties.

MJM will assist customers in submitting and processing manufacturer warranty claims; however, MJM does not provide warranties beyond those offered by the manufacturer and does not assume responsibility for outcomes beyond the manufacturer's determination.

​

Warranty claims may require evaluation by the manufacturer before replacement, repair, or credit is issued. Nothing in these Terms limits rights or remedies that cannot legally be waived or limited.

All returns, exchanges, credits, and refunds are governed by the separate MJM Ultimate Services Return and Refund Policy, which is incorporated into these Terms by reference.

Users may not use MJM's website or systems to:

· Engage in fraudulent or unlawful activity;

· Attempt unauthorized access to MJM systems or customer accounts;

· Introduce malicious software or interfere with website operation;

· Copy or commercially exploit MJM website content without authorization; or

· Misrepresent identity, company affiliation, purchasing authority, or payment information.

The MJM Ultimate Services name, branding, website content, graphics, photographs, text, and other proprietary materials owned by MJM may not be reproduced, distributed, or commercially used without authorization.

Manufacturer trademarks and product names remain the property of their respective owners.

To the fullest extent permitted by applicable law, MJM Ultimate Services shall not be liable for indirect, incidental, special, exemplary, or consequential damages resulting from the use, misuse, modification, improper selection, improper maintenance, or failure of products sold by MJM.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the extent permitted by law, customers agree to indemnify and hold MJM Ultimate Services harmless from claims, damages, or expenses arising from the customer's unlawful use, unauthorized modification, resale misrepresentation, or misuse of products, except to the extent caused by MJM's own negligence, misconduct, or other liability that cannot legally be waived.

These Terms shall be governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any legal proceeding arising from these Terms shall be brought exclusively in a court of competent jurisdiction located in Suffolk County, New York, unless otherwise required by applicable law.

MJM Ultimate Services may update these Terms periodically. Changes will become effective when the revised Terms are posted, unless otherwise stated.

The Terms in effect at the time of a transaction will govern that transaction unless otherwise agreed in writing.
